Constitution Reigns Supreme: CJI Gavai Calls for Democracy’s Dream Teamwork

Chief Justice of India (CJI) B R Gavai has reminded the country of the superiority of the Constitution of India, urging harmonious collaboration between the three pillars of democracy-judiciary, the executive, and the legislature. Addressing a felicitation function held by the Bar Council of India, CJI Gavai reiterated that it is the Constitution, and not a particular institution, which stands supreme, and reaffirmed his resolve to preserve its ideals during his term of office.

CJI Gavai asserted that neither the judiciary, nor executive, nor legislature is preeminent; the Constitution alone is so.
He emphasized that all three arms have to operate in the constitutionally prescribed framework and appreciate each other's domains.

Guidance Provided by Kesavananda Bharati Judgment

CJI held out the reference to the landmark case of Kesavananda Bharati, saying it is still the guiding force when settling the disputes between Fundamental Rights and Directive Principles of State Policy.
He characterized Fundamental Rights and Directive Principles as the "soul of the Constitution" and both necessary for realizing justice.

Diversity and Representation in Judiciary

Justice Gavai promoted greater diversity in judicial appointments, calling upon high courts to nominate more women and Scheduled Castes, Scheduled Tribes, and Other Backward Classes candidates.
He emphasized the relevance of merit and social representation in the judiciary, reflecting hopes from the legal community.
