SC Clears the Air— Customs and GST Officers Get the Green Light for Arrests!
The Supreme Court has held that the constitutional validity of arrest provisions of the Customs Act and the Central Goods and Services Tax (CGST) Act remains intact, subjecting such provisions to strong protection mechanisms for the rights of taxpayers. The ruling allows GST and Customs officers to arrest tax evasion suspects but with a strict requirement of following procedural safeguards.

Arrests must be based on credible evidence and not employed as a coercive tool of recovery of tax.
• People can apply for anticipatory bail even prior to filing an FIR.
• People in custody are entitled to rights under the Code of Criminal Procedure, with the right to advice from a lawyer as well.
The court also directed proper guidelines to be formulated to prevent any misuse of power of arrest with proportionate balancing of revenue protection with individual liberty.
This judgment has been viewed as a step in the direction of curbing "tax terrorism" with accountability in tax recovery.
