High Court Halts Haryana’s Stilt-Plus-Four Housing Policy Over Infrastructure Concerns

The court’s decision came after petitions challenged the July 2024 notification that allowed construction of stilt-plus-four floors on residential plots, raising the earlier cap of stilt-plus-three. A physical inspection in Gurugram revealed crumbling civic infrastructure, prompting the bench to intervene.

The Haryana government introduced the stilt-plus-four policy to maximize housing density and generate revenue. It permitted four-storey residential buildings with stilt parking, even allowing composition mechanisms in cases where building plans had not been approved.

The division bench, led by Chief Justice Sheel Nagu, noted that the state appeared to prioritize revenue over public safety. The judges highlighted acute shortages in water supply, sewage systems, and road infrastructure, warning that unchecked vertical growth could worsen urban liveability.

Gurugram, already facing severe infrastructure strain, was identified as the most affected region. The court emphasized that the city’s civic spine is “crumbling” under the weight of rapid construction, making further approvals unsustainable without major upgrades.
